These Terms of Service (“Terms”) apply to your use of the PEARLYHAVEN online store and any purchase you make from us. By using the store or placing an order you agree to these Terms. If you do not agree, please do not use the store.

1. Who we are

The store is operated by PEARLYHAVEN (“we”, “us”). Contact: pearlyhaven.com@gmail.com. The store is hosted on Shopify.

2. Eligibility

You must be at least 18 years old, or the age of majority where you live, to place an order. Minors may use the store only with the involvement of a parent or guardian.

3. Products

  • Our products are DIY craft kits. You assemble the ornament yourself; the finished look depends on how the kit is completed.
  • We try to show colors and details accurately, but screens vary and pearl and gem colors may differ slightly from the photos. Some lifestyle photos are illustrative.
  • Sizes are approximate (8" × 8" or 10" × 10").
  • WARNING: CHOKING HAZARD – Small parts. Not for children under 3 years. Children should use the kit only with adult supervision.

4. Prices and payment

  • Prices are shown in U.S. dollars. Applicable taxes and shipping costs are shown at checkout.
  • Bundle discounts are applied automatically in the cart and cannot be combined with other discounts unless stated.
  • We may change prices at any time, but changes do not affect orders already confirmed.
  • If a product is listed at an obviously incorrect price because of an error, we may cancel the order and refund you in full.

5. Orders

Your order is an offer to buy. We accept it when we ship the products. We may refuse or cancel an order (for example for suspected fraud, stock or pricing errors); if we do, we will refund any amount you paid.

6. Shipping, cancellations and returns

Shipping times are described in our Shipping Policy. Cancellations, returns and refunds are described in our Refund Policy. Risk of loss passes to you when the package is delivered to the carrier’s stated delivery address.

7. Your account

You are responsible for keeping your login details confidential and for activity under your account.

8. Acceptable use

You may not use the store for any unlawful purpose, to interfere with its operation, to submit false information, or to copy, scrape or resell our content or products without our permission.

9. Intellectual property

All content in the store, including text, photos, designs, logos and graphics, belongs to us or our licensors and may not be used without our written permission.

10. Reviews and messages

If you send us reviews, photos or comments, you grant us a non-exclusive, royalty-free license to use them in connection with our store and marketing. You confirm that your content is your own and is not unlawful or misleading.

11. Disclaimer

Except as stated in these Terms and to the extent permitted by law, the store and products are provided “as is” and “as available”. Nothing in these Terms excludes any warranty or right that cannot be excluded under applicable law, including your rights for damaged or defective products.

12. Limitation of liability

To the extent permitted by law, we are not liable for indirect, incidental or consequential damages arising from your use of the store or products, and our total liability for any claim relating to an order is limited to the amount you paid for that order. Some states do not allow these limitations, so they may not apply to you.

13. Indemnity

You agree to compensate us for claims arising from your breach of these Terms or misuse of the store, to the extent permitted by law.

14. Governing law and disputes

Please contact us first so we can try to resolve any issue informally. These Terms are governed by the laws of Poland, without depriving you of the protection of mandatory consumer laws of the U.S. state where you live. You may bring a claim in the courts where you live or in small claims court where available.

15. Changes

We may update these Terms. The version posted when you place an order applies to that order.
